NEARENCE PRIVACY POLICY

Nearence is owned and operated by Appertini LLC, a Colorado limited liability company (“Nearence,” “Appertini,” “we,” “us,” or “our”).
This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you use the Nearence application, website, and related services (“Service”).
Nearence is an adults-only, location-based social and event-discovery service intended primarily for users in the United States.
1. Adults Only
Nearence is strictly for people 18 years of age or older.
We do not knowingly permit minors to create accounts. If we learn that a person under 18 is using Nearence, we may terminate the account and delete associated information as appropriate.
If you believe a minor is using Nearence, contact support@nearence.com.
2. Information We Collect
Depending on the features you use, we may collect:
Account Information
Your email address and information necessary to authenticate and maintain your account.
Profile Information
Information you choose to provide, which may include your display name, “looking for” information, gender, sexual preference or orientation-related information, birthday or age information, height, weight, profile descriptions, and other profile fields.
Location Information
Approximate and/or precise location information used for features such as maps, nearby-user discovery, distance ordering, event discovery, safety features, and other location-based functionality.
Photos and Other Content
Public profile photos, optional private-gallery photos, verification selfies, and other images or content you choose to provide.
Communications
Messages and group-chat communications transmitted through Nearence, including images or other content sent through supported messaging features.
Event Activity
Information relating to events you view, search for, interact with, save, or otherwise use through Nearence, where those features are available.
Activity and Device Information
Information such as account activity, last-active or presence information, device/browser information, IP address, security logs, and push-notification tokens where applicable.
Subscription and Transaction Information
If you purchase a Nearence subscription, we may receive information concerning the transaction, such as subscription status, purchase date, renewal status, payment-provider identifiers, and limited billing information.
Payment-card information may be processed by a payment provider rather than stored directly by Nearence.
Support, Safety, and Moderation Information
Information you provide when contacting support, reporting another user, appealing a moderation decision, or communicating with us about safety, billing, legal, or privacy matters.
3. Sensitive Personal Information and Consent
Some information used by Nearence may be considered sensitive under applicable privacy laws, including precise geolocation and information concerning sexual orientation or sexual preferences.
Where required by law, Nearence will obtain your affirmative consent before processing sensitive personal information.
Consent to sensitive-data processing will be requested separately or conspicuously enough to allow you to make an informed choice and will not rely solely on general acceptance of these Terms or this Privacy Policy where separate consent is legally required.
You may withdraw consent through available privacy/account controls or by contacting support@nearence.com. Depending on the information involved, withdrawing consent may prevent Nearence from providing features that depend on that information.
4. How We Use Personal Information
We may use personal information to:
- create, authenticate, and maintain accounts;
- display and operate user profiles;
- show nearby users and order profiles by distance;
- provide maps and other location-based functionality;
- personalize visibility and discovery based on user-selected preferences;
- discover and display nearby events and activities;
- deliver direct and group communications;
- provide notifications and service communications;
- verify accounts and help prevent impersonation or abuse;
- investigate reports, moderate content, and enforce our rules;
- prevent fraud, spam, security incidents, and unlawful activity;
- process and administer subscriptions;
- respond to support, privacy, and legal requests;
- debug, maintain, analyze, and improve Nearence;
- comply with legal obligations; and
- protect the rights, safety, and property of users, Appertini, and others.
We will not materially expand the use of sensitive personal information in a manner requiring additional consent without obtaining that consent where required.
5. Location Privacy
Nearence depends on location information for important functionality.
Nearence may provide controls such as Discreet Mode that limit how your location appears to other users.
When Discreet Mode is enabled, Nearence is designed not to send your precise coordinates to other users through the map display. Nearence itself may still need to process location information to provide location-dependent functionality.
You should not assume that any location-based online service can eliminate all risk of another person inferring your approximate location from information you disclose or from your activity.
6. Public and Private Information
Information you place on your public profile may be visible to other Nearence users according to your settings.
Your private gallery is designed to remain hidden unless you choose to unlock it for another user. You may re-lock access using available controls.
Messages are visible to their intended participants and may be accessed by authorized Nearence personnel where reasonably necessary for safety, abuse investigations, legal compliance, technical support, or enforcement.
Moderators and administrators may review reported, flagged, or otherwise relevant content where necessary to operate and protect the Service.
7. Event Information
Nearence may use your location and other relevant settings to identify or display nearby events.
Event information may be supplied by third parties, public sources, APIs, venues, organizers, or users.
If you leave Nearence to interact with an event provider or third-party website, that third party’s privacy practices apply to information you provide directly to it.
8. Service Providers
We use service providers to operate Nearence. Depending on our current infrastructure, these may include providers for:
- cloud hosting, servers, and databases;
- authentication and email delivery;
- maps and location functionality;
- payment and subscription processing;
- security, monitoring, and fraud prevention;
- customer support; and
- other infrastructure necessary to provide Nearence.
Service providers may process personal information on our behalf subject to applicable contractual and legal restrictions.
9. How We Disclose Information
We may disclose information:
To other users: according to your profile, privacy, gallery, messaging, and visibility settings.
To service providers: as reasonably necessary to provide their services to us.
For safety and legal reasons: where reasonably necessary to comply with law, legal process, lawful government requests, investigate suspected violations, prevent fraud or abuse, or protect rights, safety, or property.
In a business transaction: in connection with a merger, financing, acquisition, reorganization, bankruptcy, sale of assets, or similar transaction, subject to applicable law.
We do not currently sell personal information or share personal information for cross-context behavioral advertising, and we do not currently use Nearence personal information for targeted advertising.
If those practices materially change, we will update this Policy and provide any notices, consent mechanisms, or opt-out rights required by law.
10. Messages and Retention
Nearence currently automatically deletes direct and group messages after approximately 30 days, including supported photos sent within those chats.
Profile-gallery photos are not subject to the same automatic message-deletion schedule.
We may retain particular records longer where reasonably necessary for security, fraud prevention, legal compliance, disputes, abuse investigations, enforcement, financial recordkeeping, or preservation obligations.
Routine backups may retain residual copies temporarily until overwritten according to normal backup cycles.
11. Account Deletion
You may permanently delete your Nearence account using available account controls.
Account deletion is intended to remove or de-identify your profile, photos, messages, and related account records from active systems, subject to legitimate retention requirements and temporary backup copies.
Certain records may be retained where required or permitted by law, including records needed for fraud prevention, financial accounting, dispute resolution, legal obligations, safety enforcement, or defending legal claims.
12. Cookies and Similar Technologies
Nearence currently uses storage and technologies reasonably necessary to operate the Service, such as secure session cookies and local device/browser storage for authentication and settings.
We do not currently use third-party advertising or cross-site behavioral advertising cookies.
If our tracking or advertising practices materially change, this Policy will be updated and consent or opt-out controls will be provided where required.
13. Security
We use reasonable administrative, technical, and organizational safeguards designed to protect personal information.
Measures may include encryption in transit, authentication controls, restricted administrative access, logging, and other security practices appropriate to the Service.
No internet-connected system can be guaranteed completely secure.
Because Nearence may authenticate users through email, you are responsible for protecting access to the email account associated with your Nearence account.
14. Data Breaches
If we discover a security breach affecting personal information, we will investigate and provide notifications to affected individuals, regulators, or others when required by applicable law.
15. U.S. Privacy Rights
Depending on where you live and whether a particular privacy law applies to Appertini, you may have rights concerning your personal information, potentially including rights to:
- confirm whether we process your personal information;
- access personal information;
- obtain a portable copy of certain information;
- correct inaccurate information;
- delete information;
- withdraw consent to certain sensitive-data processing;
- opt out of qualifying sales, targeted advertising, or profiling;
- appeal certain privacy-request decisions; and
- exercise privacy rights without unlawful discrimination.
Because we do not currently sell personal information or use it for targeted advertising, some opt-out rights may not presently apply to our practices.
You can edit certain information and delete your account directly through Nearence.

We may need to verify your identity before fulfilling a request. Authorized agents may submit requests where applicable law permits them.
If applicable law gives you a right to appeal our response to a privacy request, you may submit an appeal to the same email address with “Privacy Appeal” in the subject line.
16. California Residents
If California privacy law applies to Appertini’s processing of your information, California residents may have additional rights regarding access, correction, deletion, portability, sensitive personal information, sale, and sharing.
Nearence does not currently sell personal information or share it for cross-context behavioral advertising.
We will not unlawfully discriminate against you for exercising applicable privacy rights.
17. Colorado and Other State Residents
Residents of Colorado and other states with comprehensive consumer privacy laws may have additional rights where those laws apply to Appertini.
Nearence processes sensitive information such as precise geolocation and sexual-preference/orientation-related information only with consent where applicable law requires consent.
Applicable residents may contact support@nearence.com to exercise rights or appeal an applicable privacy decision.
18. Children’s Privacy
Nearence is not directed to children and is available only to adults 18 or older.
If we learn that we have collected personal information through a Nearence account belonging to someone under 18, we will take appropriate action, which may include terminating the account and deleting associated information.
Reports concerning suspected underage users should be sent promptly to support@nearence.com.
19. Users Outside the United States
Nearence is currently operated from the United States and is intended primarily for users in the United States.
If you access Nearence from another country, your information may be transferred to and processed in the United States, and you are responsible for determining whether your use complies with applicable local law.
We may restrict availability in particular jurisdictions.
20. Changes to This Policy
We may update this Privacy Policy as Nearence develops, our data practices change, or legal requirements change.
We will update the effective date and provide additional notice or obtain consent when required for material changes.
